Terms and Conditions of Use

1. Acceptance of the Agreement

By accessing and using the website https://langcom.org/ (the “Website”) and the educational platform https://campus.langcom.org/ (the “Platform”), you (the “User”) declare that you have read, understood, and accepted to be legally bound by these Terms and Conditions. These terms are governed by current Peruvian legislation.

Langcom Peru, located at Luzuriaga Avenue 971, Huaraz, Ancash, Peru, reserves the right to modify these Terms at any time without prior notice. Continued use of the site constitutes tacit acceptance of any changes.

2. Use of the Website and Platform

a. User Registration

To access specific features (classes, bookings, or progress tracking), the User must register with truthful and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials.

b. Permitted and Prohibited Use

The Website and Platform are intended strictly for English language education. It is forbidden to:

• Use the site for illegal or fraudulent purposes.

• Introduce malware, viruses, or engage in “hacking” or unauthorized “scraping.”

• Impersonate others or falsify affiliation with Langcom.

• Distribute defamatory, offensive, or discriminatory content.

3. Intellectual Property

All content, teaching materials, texts, images, videos, logos, and software are the property of Langcom Peru or its licensors. They are protected by Peruvian intellectual property laws and international treaties. Unauthorized use, reproduction, or distribution is strictly prohibited.

4. Affiliate Program Terms

By signing up for the Langcom Affiliate Program (“Program”), you agree to the following specific conditions:

a. Eligibility and Registration

• Requirements: You must be at least 18 years old and a resident of Peru.

• Human Only: Accounts registered by “bots” or automated methods are not permitted.

• Single Account: Only one account is allowed per person or legal entity.

b. Links and Tracking

• Special Links: You will be assigned a unique Affiliate Code. To earn commissions, you must use the specific link formats provided.

• Attribution: Commissions are generated only if the purchase is completed during the same session as the click-through. Langcom is not responsible for untracked sales due to incorrect link usage.

c. Commissions and Payments

• Threshold: The minimum payment amount is S/ 80.00. Commissions will accrue until this threshold is met.

• Schedule: Payments are made monthly via bank transfer within the 10 business days following the end of the month.

• Restrictions: You may not earn commissions on your own product accounts or through fraudulent/aggressive marketing methods.

d. Relationship of Parties

The relationship is that of independent contractors. Participation in this Program does not create an employment, partnership, or agency relationship. You have no authority to make representations on behalf of Langcom.

5. Limitation of Liability and Guarantees

• “As Is” Basis: The Platform is provided “as is” and “as available.” Langcom does not guarantee uninterrupted or error-free access.

• Liability Cap: Langcom Peru will not be liable for direct, indirect, or consequential damages (including loss of revenue or data) arising from the use of the site or Program.

• Third Parties: We are not responsible for the content or privacy practices of external links provided on our site.

6. Indemnification

The User agrees to indemnify and hold harmless Langcom Peru and its personnel from any claims, damages, or expenses (including legal fees) arising from the User’s breach of these Terms or infringement of third-party rights.

7. Termination

Langcom Peru reserves the right to suspend or terminate any account at its sole discretion, without prior notice, for violations of these Terms.

• Effect of Termination: Upon termination, you must immediately cease using all Langcom resources and promotional materials.

• Forfeiture: Commissions earned through fraudulent or prohibited practices will be forfeited.

8. Dispute Resolution

Any dispute relating to these Terms or the Affiliate Program shall be resolved through:

1. Extrajudicial Conciliation: At a center authorized by the Ministry of Justice in Peru.

2. Arbitration: If conciliation fails, disputes will be settled by arbitration in accordance with the Peruvian Arbitration Law.

The legal venue for all proceedings is Huaraz, Peru, and the laws of the Republic of Peru shall apply exclusively.

9. Final Provisions

• Entire Agreement: These Terms constitute the entire agreement between the User and Langcom Peru.

• Severability: If any provision is found invalid by a court, the remaining provisions remain in full force.

• No Waiver: Failure to enforce any right does not constitute a waiver of that right.
